    Conditions of Sales
    All orders placed with Theis Motorsport constitute the acknowledgment and acceptance of all conditions listed within these terms and conditions and any others listed on www.TheisMotorsport.com.

    PAYPAL ORDERS can only be shipped to a VERIFIED and/or MATCHED BILLING ADDRESS-- NO EXCEPTIONS.

    All sales are final and all products sold by Theis Motorsport (the seller) are sold "as is" to the buyer. All products remain the property of Theis Motorsport until payment is made in full, this includes during chargeback proceedings while the money has been removed from our bank. Cancellations of orders are not permitted. All orders are not valid and will not be shipped until payment is made in full.

     

    Pricing

    While Theis Motorsport strives to provide accurate product pricing and shipping information, pricing and typographical errors may occur. In rare cases, Theis Motorsport cannot confirm product and/or shipping pricing until after an order has been placed. In the event that a pricing or typographical error exists with any product offered, Theis Motorsport reserves the right to cancel or refuse an order at any time without notice. In most pricing or typographical error situations, Theis Motorsport will contact you for further instruction or cancel your order with email and/or phone notification. Prices and availability are subject to change without notice.

     

    Returns
    RETURNS ARE STRICTLY AND ONLY FOR WHEN DAMAGED ITEMS ARE RECIEVED. THIS MEANS NO RETURNS FOR PRODUCTS YOU SIMPLY DO NOT WANT OR CANNOT USE FOR ANY REASON. ABSOLUTELY NO REFUNDS ON ANY SHIPPING CHARGES, this includes the original shipping to the customer from our facility or distributor that was originally included in the listed price you already paid. No returns ever on: truck frieghted part, seats, turbos and superchargers.

    All returns or exchanges that we agree too are subject to at least a 20% restocking fee. All returned or exchanged merchandise must be new and in its original saleable packaging and include all original documentation, instructions, warranties, and hardware. The original invoice and/or packing slip must also be provided with the return or exchange. ***No merchandise will be returned or exchanged that show signs of being opened, used, installed, modified, and/or painted.*** (If installed parts are sent to us you can expect no refund and to have to pay for outgoing shipping for the return of the item to you, the customer.) Returned or exchanged items will ONLY be accepted if the item is returned within 5 calendar days from receipt of merchandise. Returns and exchanges must be sent and insured for the full value of the merchandise by the buyer. A FREIGHT COLLECT RETURN will be refused by Theis Motorsport If a refusal at the time of delivery does not (or cannot) occur, the shipping charges based on your chosen carrier will be charged to your credit card. All returned merchandise must have a RETURN AUTHORIZATION NUMBER issued by Theis Motorsport All returns without an RA (Returned Authorization) number will be refused and/or become the property of Theis Motorsport

    Please keep all original packaging, including packing materials and original shipping carton. DO NOT RETURN DAMAGED PARTS WITHOUT PRIOR AUTHORIZATION from Theis Motorsport A return authorization (RA) number is issued by Theis Motorsport and must accompany all returned or exchanged merchandise.

    Cancelled Orders
    Cancelled orders, ONLY when the item is out of stock, will be refunded by us within 24-72 business hours of your request, YOUR bank can (and usually will) take at least 3-14 days to show the credit. For ALL other cancelled orders a 5% cancellation fee applies without exception, this charge will cover the costs we incur when we both process and return your payment(s).

    Damaged Shipments
    Inspect your package carefully while the delivery company is STILL PRESENT AND ON SITE. Be sure to note ANY PROBLEMS OR DAMAGE PRIOR to signing for (or accepting) the delivery. Receiving the item will act as confirmation that the item was received in expected condition. Even if the package appears to be in good condition, open it immediately and check for hidden damages. If a damaged part is received be sure the shipping company is notified before informing Theis Motorsport Be sure to contact both parties within 24 hours of receipt. Damaged shipments REQUIRE that the delivery companies confirmation was MARKED as damaged by YOU, the customer.

    FREE Shipping Offer
    Our FREE shipping applies to items priced with shipping included and is only available to packages shipping withtin the continental United States. All other locations will be checked out with FREE shipping and the shipping fees will be dealt with on a case by case basis manually by a Theis Motorsport staff member. All non continental USA shipment payments must be received and completed before the item is shipped to the customer.

    Price Matching Promise
    If you are about to make a purchase and discover a lower advertised price offered by a retail competitor on the same available brand and model, let us know and we will either adjust the price for everyone online or we will adjust your invoice only after placement of your order at our websites regular price.

    The item must be identical, including model number, color, revision, etc. The item must be in immediate stock and available for purchase at that price only from authorized U.S. resellers, whose authorization we reserve the right to verify. No EBAY price matching what-so-ever.

    Proof of price will be considered a competitors currently and correctly priced URL. We reserve the right to call the competitors store to verify the lower price and availability of the item. Please note, many (if not MOST) competitors websites are not up to date in terms of current pricing due to industry price updates.

    ** Price matching ONLY applies at the time of ordering, not after. ** All price matches of competitors website MUST INCLUDE SHIPPING ** All price matching are subject to management approval.

    We do not price match auction items, international stores, or special events (e.g., grand opening, anniversary, group-by, clearance or liquidation sales). We also do not price match taxes, shipping fees, refurbished parts, used parts, and/or typographical errors.

    Sometimes a retailer will advertise a very low price for a product but have only limited quantities in stock. If the item is out of stock or the competitor has limited quantities of an item, it is not eligible for price matching. Likewise, if Theis Motorsport has a product that is limited in quantity it will not be eligible for price matching.

    Any coupon or rebate will be excluded from calculating a price match, Theis Motorsport will not deduct coupons or rebates from price match prices. We may limit the quantities of price-matched items, particularly if the other company does. In addition, we reserve the right to limit quantities sold to a customer.

    Special Orders
    All special orders, like all in-stock orders, require the full payment upon ordering, we will notify you during a phone order or contact you after a web order is made to clarify the item is special order and verify you want to wait for that particular item. Wait times on special order parts can vary immensely, sometimes weeks, sometimes months and in some cases up to a year or more for back ordered japanese origin parts. If a cancellation occurs by the buyer for any reason during that wait time, the full payment is forfeited. Theis Motorsport is not liable for late shipments. Shipping dates are approximate. Buyer shall not be entitled to chargebacks, reductions in price, and/or other offsets, as a result of a late shipment(s) or failure to deliver in the approximated delivery date or timeframe. No exchanges, refunds, or store credit will be issued on any special order item, all sales are final.

    Gift Certificates and Store Credit
    Gift Certificates and Store Credit will expire and will not be redeemable one year from the date of purchase or the date the credit was issued.

    Shortages/Back Orders
    If an item is placed on back order status, the item will be shipped immediately upon its renewed availability.

    Warranty/Liabillity
    All merchandise sold by Theis Motorsport is only subject to manufacturers warranty and conditions. Theis Motorsport gives no warranties, expressed or implied, including, but not limited to warranties of merchantability and fitness for a particular purpose. Theis Motorsport is not liable for any damages, which are incurred directly, or indirectly on the vehicles or operators or passengers of the vehicles. This includes problems or damage arising from the correct or incorrect installation of any product we sell.

    Performance Products
    Theis Motorsport is engaged in selling after-market items. The buyer understands and accepts the ramifications for installing and owning performance and/or after-market vehicle parts. Theis Motorsport is not accountable for any misconception or disappointments associated with any sold parts. All engine, exhaust, performance, and modification parts are legal for off road use only.

    Contingencies
    Theis Motorsport is not liable for any failure to produce a product to a buyer when the cause of such failure is an act of nature, labor dispute, supplies or material shortages; acts of local, state, national, civic or other authorities of public agencies, utility or communication failures, accidents, strikes, transportation problems, or any act or cause does not normally occur in the ordinary course of sellers business.

    Installations
    All installations will be done in a timely manner. All parts removed from vehicles, will be returned to the vehicle owner unless otherwise noted or communicated. Any part left by the vehicle owner at Theis Motorsport premises for over 30 (thirty) days will be considered property of Theis Motorsport Buyer will indemnify and hold Theis Motorsport harmless from all liabilities with buyers vehicle, which would inhibit seller from doing the install or said work, it will be at Theis Motorsports option to get needed parts for buyer at buyers expense. Theis Motorsport will not be liable for any loss, damage, or theft of vehicles or articles left inside the vehicle while Theis Motorsport has possession of buyers vehicle.
